This Agreement may be terminated or cancelled;
at anytime by either party by giving the other party thirty (30) days prior written notice, provided that we may charge You a minimum $35.00 charge as an early cancellation fee.
If an account with a thirty (30) day money-back guarantee is purchased and cancelled within thirty (30) days of sign-up, the User will, upon request, receive a full refund of all hosting fees. Requests for these refunds should be made through our Support Team. Refunds made for a thirty (30) day money-back guarantee will not include domain registration fees or setup fees, nor will they include any fees for additional services that are purchased in the first thirty (30) days. If your plan includes a free domain name and You cancel within the first 30 days, a fee for the domain (and any applicable taxes) will be deducted from your refund. If you do not wish to keep the domain name, Hosting Direct will take possession of the domain and the fee will not be charged.
The thirty (30) day money-back guarantee is valid for credit-card payments only. Due to the costs associated with processing payments made by other methods, we are not able to offer the thirty (30) day money-back guarantee for other payment methods.
If for some reason your server isn’t up for the guaranteed time, we will credit your account the difference.
While we rarely have server issues that result in downtime, there may be instances when downtime does occur. We feel that if the servers are down, the customer should not have to pay. This is why we carry a strict 99.9% Uptime Guarantee. Unlike other hosts that offer guarantees but never state what may occur if there is downtime due to server errors, etc. we wanted to make it very clear that we do stand behind our product and try our very best to assure that your service is never interrupted without some sort of compensation. We stand behind our network reliability by offering you a pro-rated credit for any downtime outside guaranteed uptime.
Please note that this guarantee applies only to unscheduled outages. Occasionally, we will need to perform upgrades, updates, maintenance, etc. While we do try our very best to keep you abreast of any anticipated downtime and inform you well ahead of time, as well as schedule the downtimes to occur during off-peak hours, there are rare instances that are beyond our control and require immediate attention. When notice is sent at least two hours prior to service interruption, the outage does not qualify for our uptime guarantee.
